Abstract Although the adaptation right has been explicitly harmonized in the Software Directive and the Database Directive, there is no such explicit harmonization in Directive 2001/29. Because of the absent explicit harmonization, the literature is divided on the question whether the adaptation right is harmonized in Directive 2001/29. The central research question of this article is therefore whether the adaptation right is harmonized in Directive 2001/29.
