Abstract

The Iraqi legislator specified banking holding companies as a type of holding company in the effective Iraqi Banking Law No. 94 of 2004, unless he opposed their appearance on the ground due to the lack of a provision for holding companies in the Companies Law, and now, after the issuance of Law No. 17 of 2019, which stipulates this type of Companies: It has become necessary to study the provisions of bank holding companies, especially since the legislator came with scattered texts here and there in the effective Iraqi banking law and shy references to them. The importance of studying bank holding companies lies in considering them among the financial institutions that influence the country’s economy through the management of a group of subsidiary companies, including banks, and despite This importance has not been established at the time of writing our research as a bank holding company in Iraq due to the lack of complete knowledge of its provisions by the parties concerned with its establishment. Therefore, talking about the importance of holding companies in supporting economic development does not need evidence to prove its validity in light of what is witnessed in the contemporary economic reality of the role of these commercial companies. Various vital projects.
