Abstract

The article contains the text of the author's translation of Articles 1-3 of the Regulation of the Supreme People's Court of the People's Republic of China "On the review of the execution of decisions on property issues in mitigation of punishment and parole" dated 2024. As part of a brief comparative analysis with Russian legislation, a number of features of the Chinese approach are highlighted in terms of the interrelated consideration of such criteria for parole as compensation for damage caused or otherwise making amends for harm caused as a result of a crime, and the degree of remorse of the convicted person, assessing the ability of the convicted person in principle to comply with the court's decision regarding compensation for damage.
