This preprint examines the legal and transactional effect of a wzmianka in the Polish land and mortgage register system (eKW). It shows how a pending registration warning immediately suspends the Public Faith of the Land Register, depriving a buyer of core statutory protection while the content of the underlying application remains hidden from public view. The publication analyses the legal basis of the mechanism under the Act on Land and Mortgage Registers and Mortgages and the Code of Civil Procedure, explains its procedural lifecycle, and identifies the main risk categories it creates for buyers, lenders, notaries, and advisers. The paper argues that the wzmianka is not a minor technical notation but a system-level transactional barrier that can block financing, distort priority, and collapse otherwise viable property transactions through institutional delay and information asymmetry.
