The role of the systematization of types of mediation in the transformation of legal relations within correctional institutions: from conflict to legal agreement

Abstract

Based on the analysis of scientific research conducted by domestic and foreign scholars, the article examines various approaches to the systematization of types of mediation depending on the nature of the conflict, the goals of the parties, and the context of their interaction, as well as on the industry-specific characteristics of dispute resolution. The object of the research is the process of transforming legal relationships (interpersonal and group conflicts among inmates; conflicts between inmates and staff of institutions) in correctional facilities under the influence of the systematization of types of mediation, which ensures the transition from conflictual interactions to legal agreements among the participants in these relationships. The subject of the research is the types of mediation and their systematization in the context of legal relationships in the criminal enforcement sphere, while the goal of the work is to determine the role of systematization of types of mediation in the transformation of legal relationships in correctional facilities. The study employed methods such as formal-legal – for analyzing regulatory legal acts; comparative-legal – for comparing mediation models; legal forecasting when modeling the implementation of mediation procedures in the activities of criminal enforcement institutions; and content analysis of scientific publications and regulatory acts. As a result of the conducted research, it has been established that the systematization of types of mediation helps reduce the level of conflict among inmates, enhances the effectiveness of educational efforts, and accelerates the process of resocialization. The results of the study can be used in legislative activities to improve criminal enforcement legislation, in the practical work of correctional institutions to implement mediation programs, and in the educational process of the FSIN Russia's departmental universities. In conclusion, proposals are formulated for integrating systematized mediation procedures into criminal enforcement practice to enhance the effectiveness of resocialization of inmates and to humanize the penitentiary environment. The main conclusion of the conducted research is that the systematization of types of mediation is a key factor in the transformation of legal relationships in correctional institutions. Its implementation contributes to a reduction in the number of conflicts, the formation of a culture of constructive dialogue, and the achievement of legal agreements among the participants in legal relationships.
