Abstract

Title Constitutional Software Analysis (CSoftA) is a structural methodology for evaluating governance in software systems. The framework classifies governance according to whether authority verification is constitutive of state-transition reachability, observational after execution, or absent at the analyzed boundary. CSoftA introduces a three-state governance model: ACTIVE Governance: authority verification is required and non-bypassable for a governed state transition. CRYSTALLIZED Governance: authority or authority verification is observed, recorded, or reconstructed but is not required for execution. ABSENT Governance: authority verification is neither required nor meaningfully preserved. The methodology evaluates software systems at explicit authority boundaries and analyzes governance in terms of reachability, verification, enforcement, bypass resistance, governance composition, and authority location. The accompanying corpus applies the framework across eighty software systems spanning cloud infrastructure, identity and access management, Kubernetes ecosystems, service meshes, secrets management, infrastructure as code, CI/CD platforms, observability systems, databases, messaging platforms, security tooling, and machine learning infrastructure. The central contribution is a reproducible analytical framework for determining whether governance mechanisms actually constrain execution or merely preserve evidence of execution. This publication includes the CSoftA theory paper, analytical methodology, governance classification framework, and associated research corpus.
