With the tremendous technological advancements in medicine, medical service providers are increasingly affected by these developments, increasing their burdens of bearing the consequences of this development and the resulting medical liability. Compulsory insurance is the means by which the state can address these risks. Compulsory insurance provides a support for physicians who are unable to bear the burden of liability resulting from medical injuries alone. Medical service providers may be unable to pay the estimated compensation for medical injuries due to economic inability. Economic conditions may prevent medical service providers from bearing the compensation for damages resulting from medical work, and compulsory insurance is the means to achieve this The analytical and comparative approach will be followed in this research, as we will analyze the legal texts and jurisprudential opinions related to the subject of our research, and we will also compare the civil law texts in this regard with the texts of special laws.
