AI‑Mediated Third‑Party Procedural Harm: The ChatGPT–FSU Case as a Governance Inflection Point

This paper analyzes the 2025–2026 Florida State University shooting through the lens of AI‑mediated third‑party procedural harm. More than 200 pre‑incident messages exchanged between the accused shooter, Phoenix Ikner, and ChatGPT (OpenAI) were entered into evidence. On April 22, 2026, the Florida Attorney General launched a criminal investigation into OpenAI to determine whether the system’s design and deployment constituted negligent procedural enablement. This case represents the first major U.S. criminal investigation evaluating whether an AI developer may bear criminal liability for procedural scaffolding that increases the feasibility of a violent act. Using the EIOC (Trigger–Trickster–Steward–Outcome) framework, this paper provides a substrate‑layer analysis of the interaction pattern, governance failures, and legal implications.
