The Effects of Civil Liability for Missing An Opportunity for Moral Gain: Missing An Opportunity for Marriage as An Example

The Iraqi civil legislator, unlike some other legislators, has not explicitly addressed liability for the loss of a chance to marry, leaving it subject to the general rules of civil liability. This legislative silence has engendered numerous legal complications. The absence of specific statutory provisions often renders it impossible for an individual who has lost a marriage opportunity to obtain compensation that mitigates or redresses the sustained harm. Furthermore, aggrieved individuals may suffer damages resulting from such a loss without knowing the legal mechanisms required to hold the responsible party liable. Research Objective: Compensation, in its broad sense, encompasses redress for both pecuniary and non-pecuniary damages. In its narrow sense, it refers to the reparation of harm and the restoration of the victim’s financial position to its pre-damage state. This assumes the possibility of eliminating the harm, either through monetary payment equivalent to the loss or through restitution in kind (specific performance). This study aims to explore the legal framework for compensating the loss of a marriage opportunity within these dimensions. Methodology: This study adopts a comparative analytical approach by examining and analyzing juristic opinions and legal texts relevant to the subject. It provides a comparative analysis of the Iraqi and Egyptian legislative positions, among other jurisdictions, while incorporating perspectives from Islamic Jurisprudence where applicable. Conclusion: The study concludes with several key findings and recommendations. Notably, it asserts that monetary compensation, when applied judiciously, does not diminish the sanctity of emotional relationships; rather, it restores the balance between parties when disrupted by a third party's fault. Furthermore, the concept of non-monetary compensation is embodied in "Judicial Marriage," where a court order obliges parties to conclude a marriage contract based on a proven and legitimate prior promise. Importantly, if a judicial marriage claim is accepted, it is not considered a form of compulsory specific performance; instead, it pertains to the guardian’s (Wali) refusal rather than the coercion of the spouse. أن المشرع المدني العراقي لم يتعرض كغيره من المشرعين للمسؤولية عن فوات فرصة الزواج بل تركها للقواعد العامة في المسؤولية المدنية، ونتيجة لذلك الوضع ظهرت الكثير من المشكلات القانونية. فعدم وجود نص قانوني مختص بهذا الموضوع نتج عنه أن الشخص الذي فاتت عليه فرصة الزواج يستحيل عليه احياناً الحصول على التعويض الذي يجبر أو يخفف الضرر الذي أصابه، وقد يصل الأمر بهذا الشخص أن يصاب بأضرار ناتجة عن تفويت فرصة الزواج عليه ولا يعلم حتى كيف يُثير مسؤولية الشخص المسؤول عن ذلك. الهدف: وبما أن للتعويض معنى واسع يشمل تعويض الأضرار المالية وغير المالية التي تصيب المضرور، ومعنى آخر ضيق يعني اصلاح الضرر وجبره، بمعنى أخر إعادة المركز المالي للمضرور إلى ما كان عليه قبل وقوع الضرر، ويفترض فيه إمكانية إزالة الضرر ورفعه، إما عن طريق دفع مبلغ من النقود مساوي لثمن الشيء الذي أضير وإما عيناً. المنهجية: تم الاعتماد في كتابة هذه الدراسة على المنهج التحليلي المقارن، من خلال بيان وتحليل أراء الفقهاء والنصوص القانونية المتعلقة بموضوع الدراسة، في أطار من الدراسة المقارنة بين موقف المشرع العراقي والمصري وغيرها من القوانين، ومقارنتها مع الفقه الاسلامي، كيفما تيسر ذلك. الاستنتاجات والتوصيات: أن التعويض النقدي حين يمارس بحكمة لا يقلل من قدسية العلاقة العاطفية بل يعيد التوازن بين الأطراف حين يختل بسبب خطأ الغير. وان فكرة التعويض غير النقدي تتجسد في حالة التزويج القضائي، أي صدور حكم من المحكمة يلزم الطرفين بإبرام عقد الزواج بناءً على وجود وعد سابق ثابت ومشروع بالزواج. كما لا تعد دعوى التزويج القضائي في حال قبولها صورة من صور التنفيذ العيني الجبري وإنما تتعلق بولي الأمر وامتناعه لا بالزوج نفسه.
